2. Burglary as a Crime Involving Moral Turpitude

Burglary should be treated as a crime involving moral turpitude (“CIMT”) only if the intended, underlying offense involved moral turpitude. Entry with intent to commit larceny is a CIMT, while entry with intent to commit an undesignated offense (“a felony”) or an offense such as simple assault or malicious mischief that does not involve moral turpitude is not.
